Terms of Service
These terms govern your use of pacific-battery.com and your interactions with Current State, LLC (doing business as Pacific Battery Company). Last updated April 21, 2026.
1. Acceptance of these terms
These Terms of Service ("Terms") are a binding agreement between you and Current State, LLC, a California limited liability company also registered to do business in Nevada, operating under the trade name "Pacific Battery Company" ("Pacific Battery," "we," "us," or "our"). By accessing or using pacific-battery.com (the "Site") or by submitting an inquiry, quotation request, or other communication through the Site, you agree to these Terms. If you do not agree to these Terms, do not use the Site.
Orders for goods or services are subject to a separate, signed commercial agreement, purchase order, or terms of sale. Nothing on the Site constitutes an offer capable of acceptance by you, and no contract for the purchase of goods is formed through the Site alone.
2. Who can use the Site
The Site is intended for use by business users aged eighteen (18) or older who are authorized to act on behalf of a company or other organization. By using the Site, you represent and warrant that you meet these eligibility requirements.
3. Informational purpose
The Site provides information about our products, engineering services, and company. Product specifications, photographs, diagrams, certification codes, and related technical data are presented for general informational purposes. We make reasonable efforts to keep content accurate and up to date, but we do not warrant that any information on the Site is complete, current, or error-free, and we reserve the right to update, correct, or remove content at any time without notice. Final specifications, commercial terms, lead times, certifications, warranties, and deliverables for any specific project are those set forth in a signed written agreement with us.
4. Intellectual property
The Site and its content — including text, graphics, logos, images, product photography, technical drawings, videos, downloadable resources, software, and the overall look and feel — are owned by or licensed to Current State, LLC and are protected by United States and international copyright, trademark, trade dress, and other intellectual property laws.
"Pacific Battery Company," the Pacific Battery logo, and related marks are trademarks of Current State, LLC. All other trademarks, service marks, and trade names referenced on the Site are the property of their respective owners.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your internal business purposes. You may not reproduce, distribute, modify, publicly display, publicly perform, create derivative works from, sell, or otherwise exploit any portion of the Site or its content without our prior written consent, except as permitted by applicable law.
5. Submissions and feedback
If you submit information, ideas, suggestions, feedback, or other content to us through the Site, email, or any other means (collectively, "Submissions"), you grant Current State, LLC a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, modify, and incorporate the Submissions for any lawful purpose, including to improve our products and services, without any obligation of compensation or attribution. You represent that you have the right to make each Submission and that the Submissions do not infringe the rights of any third party.
Do not send us confidential or proprietary information through the Site unless we have entered into a non-disclosure agreement with you that covers the information. Submissions made without an NDA in place will not be treated as confidential.
6. Prohibited uses
You agree not to use the Site to do any of the following: violate any applicable law or regulation; infringe the rights of Current State, LLC or any third party; transmit any virus, worm, or malicious code; attempt to probe, scan, penetrate, or reverse-engineer the Site or its underlying systems; harvest or collect personal information of other users; impersonate another person or entity or misrepresent your affiliation; interfere with the operation of the Site or the experience of other users; or use the Site for any fraudulent or unlawful purpose.
7. Third-party links and services
The Site may contain links to third-party websites and services that are not controlled by us. We provide these links for convenience only and do not endorse or assume responsibility for the content, privacy practices, or operations of any third-party site or service. Your use of any third-party site or service is at your own risk and subject to that third party's terms.
8. Disclaimer of warranties
THE SITE AND ALL CONTENT, INFORMATION, AND MATERIALS ON THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CURRENT STATE, LLC DISCLAIMS ALL WARRANTIES WITH RESPECT TO THE SITE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION.
WARRANTIES FOR GOODS OR SERVICES PROVIDED UNDER A SEPARATE SIGNED AGREEMENT ARE GOVERNED EXCLUSIVELY BY THAT AGREEMENT. NOTHING ON THE SITE CONSTITUTES A PRODUCT WARRANTY.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CURRENT STATE, LLC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SUPPLIERS WILL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, BUSINESS INTERRUPTION, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.
10. Indemnification
You agree to defend, indemnify, and hold harmless Current State, LLC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Site, your Submissions, or your breach of these Terms.
11. Export and trade compliance
The Site and any information obtained from it are subject to United States export-control laws and regulations, including the Export Administration Regulations administered by the U.S. Department of Commerce and sanctions regulations administered by the U.S. Department of the Treasury's Office of Foreign Assets Control. You agree not to access, download, or use the Site in violation of any applicable export-control or sanctions law, and you represent that you are not located in, under the control of, or a national or resident of any country or a party subject to U.S. embargoes or trade restrictions.
12. Termination
We may suspend or terminate your access to the Site at any time, for any reason or no reason, without notice. Sections 4 through 14 and any other provisions that by their nature are intended to survive termination will survive termination of these Terms.
13. Governing law, venue, and dispute resolution
These Terms and any dispute arising out of or relating to them or to your use of the Site will be governed by the laws of the State of California, without regard to its conflict-of-laws principles. For matters concerning Nevada resident privacy rights, the laws of the State of Nevada, including Nevada Revised Statutes Chapter 603A, will also apply to the extent required by law.
Any dispute arising out of or relating to these Terms or the Site that is not resolved through good-faith negotiation will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction and venue of those courts. Each party waives any objection to venue in those courts and any claim that those courts are an inconvenient forum.
The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.
14. General
If any provision of these Terms is found to be unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision. These Terms, together with our Privacy Policy and any separate signed agreements between you and Current State, LLC, constitute the entire agreement between you and us concerning your use of the Site and supersede all prior or contemporaneous understandings on that subject. You may not assign or transfer these Terms or any rights under them without our prior written consent; any attempted assignment without such consent is void. We may assign these Terms freely.
15. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of the Terms. Your continued use of the Site after a change takes effect constitutes your acceptance of the revised Terms. If the change is material, we will take reasonable steps to bring it to your attention.
